Squatting is a legal concept that allows people to take possession of an abandoned property and use it as if it were their own. In California, squatters have the right to occupy an abandoned property.

More so, squatter gain the rights for adverse possession (**Claiming it's their property) if they can prove they live there for 5 continuous years of living.

Eviction process

  1. Landlord must serve WRITTEN NOTICE to the tenant.
  2. If tenant doesn't response to the letter within 5 days, then landlord can file lawsuit with court.
  3. Court serves tenant with summons and complaint.
  4. Tenant files an answer.
  5. Court holds hearing and issues judgment.

The most important during this process!

DO NOT harass the tenants.

They still hold the rights!
